FILE TRADEMARK APPLICATION
Businesses must compete for attention. A good trademark can distinguish you in a moment from competition. An effective trademark protected by federal registration offers you the best means of ownership and control of your mark and reputation.

By registering your trademark, you can...
...Deter others from infringing your mark

Perception of your trademark directly links to the identity and reputation of your company. Registration with the United States Patent and Trademark Office (USPTO) gives you the exclusive right to your mark anywhere in the United States, to prevent others from tarnishing your company's image by misusing your mark or one confusingly similar to it.

While you may use the TM or SM symbols anytime, you may only use ® for a trademark officially registered with the USPTO. The ® lets others know that the U.S. Government recognizes your exclusive rights to that mark, discouraging them from infringing your mark.

Searches by third parties let them know you own your mark, dissuading them from adopting it or one confusingly similar. Also, companies who infringe a registered mark cannot use the defense of ignorance.

The Internet is very public. Anyone can do anything, including using your mark to advertise themselves. Registration gives rights against people who buy a domain name using your mark hoping to sell it to you for a huge profit. You may also deter others who may use tools like Google AdWords with your mark in the text to divert traffic from you to them.

...Enforce your trademark rights using legal means

Occasionally, in the course of business, you might find others using a mark confusingly similar to yours. A federal registration gives you the right to sue the offending party and recover up to triple damages, any profits made while infringing, and attorney fees for litigation. Furthermore, infringing or counterfeit merchandise can be seized.

You may submit your registration to U.S. Customs to bar any imports bearing your mark from entering the country. This ensures that foreign entities cannot infringe your mark to sell their goods into the U.S..

...Provide you with opportunities to expand

Conduct business with the future in mind. A federal registration allows you to use its priority date for foreign registrations in international markets. This ensures your right to use your mark internationally if your priority date precedes any confusingly similar mark in those countries.

Cashflow is central to growing a business. Your registered trademark can be used as collateral for a bank loan because of the "good will" your company has established.
